Today's employers all share the same challenge: attracting and maintaining a high-quality workforce. At the same time, more workers are requesting flexible work arrangements to help them meet their work/life balance. Outdated workplace rules and government-mandated leave requirements often make it hard for employers to offer the arrangements that employees want. 

A bill to expand paid leave and workplace flexibility opportunities, which was developed with the support of Society for Human Resource Management (SHRM) members, was introduced in Congress in November 2017. The bill could give employees more options and flexibility when taking time off to meet their individual and family needs while providing predictability for employers who now face a hodgepodge of overlapping state and local requirements. 

The workflex bill (H.R. 4219) would amend the Employee Retirement Income Security Act (ERISA) to create a qualified flexible work arrangement plan. To qualify as an ERISA-covered plan, the plan would have to include two components: a federal paid leave standard and flexible work arrangements for all employees. Employer participation would be voluntary.

With this bill, employers who opt to offer the ERISA-covered plan would enjoy improved predictability by being able to follow a federal framework for paid leave and workflex, as opposed to the complex, conflicting patchwork of state and local laws.

Johnny C. Taylor, Jr., SHRM-SCP, president and chief executive officer of the Society for Human Resource Management is convinced: "The bill would provide employees with leave and flexibility, help businesses attract and retain the talent they need, and allow businesses to grow and thrive." 

Rep. Tim Walberg, R-Mich., the committee's chairman affirms: "The Workflex in the 21st Century Act is a win-win for businesses and their employees and provides Americans with the flexibility they desire when it comes to striking the right work/life balance."
